These Terms of Service ("Terms") govern your use of the Pally website accessibility audit service ("Service") operated by Pally Compliance, LLC ("Pally," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms.
1. Description of Service
Pally provides automated website accessibility scanning and AI-assisted reporting to help identify potential accessibility issues under WCAG 2.1 AA guidelines.
2. No Legal or Compliance Guarantee
IMPORTANT: Pally is a diagnostic and educational tool. Use of the Service does not guarantee legal compliance with the Americans with Disabilities Act (ADA), Section 508, WCAG, or any other accessibility standard or law. Pally's reports are not legal advice, and no attorney-client relationship is created by use of the Service. Automated scanning tools, including Pally, cannot detect all accessibility issues — human expert review is required for full compliance evaluation.
Do not represent to any third party, including in legal proceedings, that a Pally report constitutes a certification of compliance.
3. Accounts
You must create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Acceptable Use
You agree not to:
- Submit URLs for scanning without authorization to do so
- Use the Service to violate any applicable law
- Attempt to reverse-engineer, scrape, or abuse the Service
- Resell or redistribute scan reports without authorization (Agency plan customers may share reports with their own clients)
5. Payment Terms
Free Tier
The free tier provides access to a limited scan preview at no cost.
One-Time Audit ($49)
A one-time payment unlocks the full accessibility report for a single scanned URL. This purchase is non-refundable once the report has been generated and delivered.
Monitor Plan ($29/month)
A recurring monthly subscription providing ongoing scanning and monitoring. You may cancel at any time; cancellation takes effect at the end of the current billing period.
Agency Plan ($99/month)
A recurring monthly subscription for multiple sites. Same cancellation terms as the Monitor Plan.
Payments are processed by Stripe. By providing payment information, you agree to Stripe's terms of service.
6. Intellectual Property
Pally and its underlying technology, branding, and content are owned by Pally Compliance, LLC. Accessibility reports generated for your scanned URLs are provided to you for your own use. You may not resell or redistribute reports except as permitted under the Agency plan.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT SCAN RESULTS WILL BE COMPLETE OR ACCURATE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PALLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY DAMAGES ARISING FROM RELIANCE ON SCAN RESULTS IN LEGAL PROCEEDINGS.
9. Governing Law
These Terms are governed by the laws of [STATE/JURISDICTION], without regard to conflict of law principles.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
